Getting married in the picturesque state of New Hampshire is a straightforward process, but understanding the legal requirements beforehand can ensure a smooth experience. Unlike some states, New Hampshire offers a degree of flexibility for couples, including non-residents.

Where to Apply

One of the most convenient aspects of obtaining a marriage license in New Hampshire is that you are not restricted to applying in the town where you reside or where your ceremony will take place. You can apply for a marriage license at any City or Town Clerk's office throughout the state, regardless of your place of residence. Once issued, the license is valid for a marriage ceremony anywhere within New Hampshire.

Application Requirements and Necessary Documents

To apply for a marriage license, both individuals must appear in person at the chosen City or Town Clerk's office. There are some exceptions for armed forces personnel who may submit an affidavit.

You will need to provide specific information and documents, so it's advisable to have these ready to avoid delays:

  • Identification and Proof of Age: Both parties must present valid photo identification, such as a driver's license or passport. Proof of age (like a certified birth certificate, if not covered by your photo ID) is also required. The minimum age to contract a valid marriage in New Hampshire is 18 years old.

  • Social Security Numbers: You will need to provide your Social Security numbers.

  • Parental Information: Be prepared to provide your parents' full names (including your mother's maiden name) and their birthplaces (state or country).

  • Previous Marriages (if applicable): If either applicant has been previously married, you must provide certified copies of the final divorce decree, annulment decree, or death certificate of a former spouse, as appropriate. These must be official court documents with a raised seal.

  • Name Change (Optional): When applying, you will also be asked to indicate how you wish your married name to appear on the marriage license. It's important to be clear about this, as any changes after the marriage would require a separate legal name change process through the court system.

 

Fees and Validity

The fee for a New Hampshire marriage license is a state-set amount of $50.00. Payment methods vary by town, but generally include cash, check, or credit card (note that credit card payments may incur an additional processing fee).

Crucially, there is no waiting period in New Hampshire. The marriage license can be issued and used on the same day of application, provided all requirements are met. The license is valid for 90 days from the date of filing. This means your marriage ceremony must take place within this 90-day window.

After the Ceremony

Once your marriage ceremony is performed by a qualified officiant (such as a Justice of the Peace or ordained clergy), the officiant is responsible for completing the marriage license and returning it to the City or Town Clerk's office where it was issued, typically within six days. After the clerk receives and processes the completed license, you can then obtain a certified copy of your marriage certificate, usually for an additional fee. This certified copy serves as legal proof of your marriage.
